Terms of Service
These terms apply when you download, install or use Jarq, and when you buy a licence for it.
The short version. Jarq is a Mac app that turns your speech into text and translates what you select. You get a personal licence for up to two of your own Macs. Payments go through Paddle, who are the merchant of record. The AI can be wrong, so check anything important. You can get your money back within 30 days.
1. Who you're dealing with
Jarq is developed and published by IP Abishev Birzhan Orynbasarovich (ИП Абишев Биржан Орынбасарович), IIN (Kazakhstan individual identification number) 930110351006, a sole proprietorship registered in Astana, Republic of Kazakhstan on 22 September 2019 ("we", "us", "our"), owned and operated by Birzhan Abishev. You can reach us at support@jarq.app.
By installing or using Jarq you agree to these terms. If you don't agree with them, don't use the app.
2. Who sells you the licence
Our order process is conducted by our online reseller Paddle.com Market Ltd. Paddle.com is the merchant of record for all our orders: they handle the payment, the invoice, all taxes, refunds and chargebacks, and they provide customer service for billing questions. Your purchase is also subject to the Paddle Buyer Terms, presented to you at checkout.
We never see or store your card details.
3. Your licence
When you buy Jarq, or while you're in the trial, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the app.
- A paid licence covers up to two Macs that you own or control.
- Your licence key is yours alone. Don't publish, share, resell or sublicense it.
- Don't attempt to circumvent the licence checks or usage limits, and don't reverse engineer the app except where the law expressly allows it.
- We keep all rights in the software, its name and its design. You're buying the right to use it, not the software itself.
4. Plans
The current plans and prices are on the pricing page.
Trial
Every install gets 14 days of full access, with no payment and no card. When the trial ends, Jarq continues on the free plan: 5 dictations or translations a day, which resets every day and never expires. The app itself, your settings and the history stored on your Mac are unaffected either way. A paid licence lifts the daily limit.
Pro, monthly or yearly
Subscriptions renew automatically at the end of each period, at the price you signed up at, until you cancel. You can cancel at any time — from your account page in the app or through the link in your Paddle receipt — and the app keeps working until the end of the period you've already paid for. After that, Jarq goes back to the free plan — five dictations or translations a day — until you subscribe again.
Lifetime
A single payment that covers every release of Jarq, including future major versions, for as long as we operate the service. There are no paid upgrades for Lifetime owners. "Lifetime" means the lifetime of the product, which is the ordinary meaning of the term in software — it is not a promise that the service will run forever.
Friends
Every installation has a code it can give away. An installation where someone's code is entered gets a month of full access from that day, on top of any it already has — on a new installation, in place of the fourteen-day trial. One code per installation, ever, and not on an installation with a licence. Whoever the code belongs to gets a month of full access once that installation has been used on three different days after the code was entered, and a year instead of a month for every third such friend. The time is added after any trial or earlier reward, on the installation the code belongs to. It is not money: it cannot be exchanged or passed on, and it does not extend a paid subscription. We may change or end the offer, and we may take back time earned through codes entered on installations that are not really someone else's; time earned honestly stays yours.
5. Fair use
Paid plans are described as unlimited, and for any normal use they are. Behind them sits a fair-use ceiling of 2,000 actions per calendar month per licence, because each dictation and translation runs on speech and language models that cost us money per request. If your usage passes it, we'll contact you before doing anything about it. We may throttle or suspend automated, scripted or shared use that goes far beyond one person working.
6. What Jarq does with your speech and text
To transcribe and translate, the app sends the audio you record and the text you select to our backend, where it's processed by AI models running on Cloudflare's or Groq's infrastructure, and returns the result. We don't store that audio or text on our servers. The full picture is in the privacy policy.
Jarq needs an internet connection to work.
7. AI output can be wrong
Speech recognition and machine translation make mistakes — they mishear names, they lose nuance, and they can produce fluent text that says something you didn't. You are responsible for reading and checking anything that matters before you send it. Don't rely on Jarq unchecked for medical, legal, financial or safety-critical content.
8. Acceptable use
- Use Jarq lawfully, and don't use it to produce unlawful, harassing or infringing content.
- Only record conversations you're entitled to record. Some countries and states require every participant's consent — that's on you, not on us.
- Don't resell access to the service or run it as a backend for another product.
9. Availability and changes
We aim to keep the service running, but we don't guarantee it will be uninterrupted or error-free. Features may change as the app develops. If we ever have to shut the cloud service down permanently, we'll give at least 60 days' notice by email to everyone with an active licence.
We may suspend or end your licence if you materially break these terms — for licence-sharing or abuse of the service, for example. Where it's reasonable to do so, we'll warn you first.
10. Refunds
You can get your money back within 30 days. See the refund policy, which forms part of these terms.
11. Warranties and liability
Jarq is provided "as is", without warranties of any kind to the extent permitted by law. We don't warrant that the transcription or translation will be accurate or fit for any particular purpose.
To the extent permitted by law, our total liability to you for any claim connected to Jarq is limited to the amount you paid us for it in the 12 months before the claim. We're not liable for indirect or consequential loss, lost profits, or lost data.
Nothing here limits liability that can't be limited by law, and if you're a consumer, your statutory rights are unaffected.
12. Changes to these terms
We may update these terms as the product changes. The current version always lives at this address, with the effective date at the top. If a change materially affects your rights, we'll email everyone with an active licence before it takes effect.
13. Governing law
These terms are governed by the law of the Republic of Kazakhstan. Your purchase transaction itself is governed by the Paddle Buyer Terms. If you're a consumer, you keep the protections of the mandatory law of the country you live in.
